Managing client expectations in

the litigation process

 

Managing clients expectations in terms of what will be achievable long term post settlement of the claim. We often see cases where clients and family members have expectations, based on what they say they have been told by the litigator acting for them, and from seeing the schedule of loss, but where we see that the case has been settled at an amount between the claimant and defendant schedules. What the clients and family thought was a fantastic settlement then turns sour when they realise that they can’t have everything that they thought that they had been promised.

Costs budgeting: the importance

of monitoring your costs budget

Costs Budgets were introduced into the CPR 10 years ago. We asked clinical negligence Solicitors for some of their burning questions surrounding them and the budgeting process, and we will discuss some of them here with you. Tom Brocklebank will talk through the questions and answers, and also address why it is so important to monitor your Costs Budget.

PPOs and the upcoming effects of the potential change in Discount rate

 

A Periodical Payment Order (PPO) is a specialised form of structured settlement that enables part of the Claimant’s damages to
be paid in regular installments, in exchange for a part of the lump sum of damages. This methodology means a Claimant will have a steady stream of tax-free index-linked income to last their lifetime, which also removes the need for investment risk. Frenkel Topping was involved in the first Structured Settlement
in British legal history in the case of Kelly v Dawes (1989) and have more than 30 years’ experience in this field.

 

This seminar will cover everything you need to know about PPOs, including the significance of the Discount Rate, which heads of damage can be linked to a PPO, why and when you should consider a PPO and the implications of local authority funding and welfare benefits.
